Terms of Service

1. Agreement

These Terms govern your access to and use of Rohy AI, operated by Everbright Ventures LLC. By using Rohy AI, you agree to these Terms and our Privacy Policy.

2. Nature of the Service

Rohy AI provides AI-assisted journaling, reflection, summaries, sharing controls, and related features for informational and productivity purposes. Rohy AI is not a medical provider, therapist, psychiatric practice, emergency service, or fiduciary adviser.

Rohy AI does not diagnose, treat, cure, or prevent disease or mental health conditions. Nothing in the service is a substitute for licensed medical, psychiatric, psychological, legal, tax, or emergency advice.

3. HIPAA and Regulated Use

Rohy AI is not offered as a HIPAA-covered clinical record system, medical device, emergency response service, or regulated clinical documentation system unless we separately enter into a written agreement expressly stating those obligations. References to providers, clinical models, care plans, cognitive patterns, CBT-style exercises, screening frameworks, or mental health snapshots are product features for reflection and organization, not representations that Rohy AI is practicing medicine or assuming a provider's professional duties.

Unless your organization has separately satisfied its own compliance requirements, provider and patient-related features should be used only for informational, educational, personal, or internal workflow purposes.

4. No Emergency Monitoring

Rohy AI is not a crisis service and does not undertake a duty to monitor, escalate, rescue, warn, or intervene based on user content. If you are in crisis or may be in danger, contact emergency services, call 988 in the United States where appropriate, or seek immediate help from a licensed professional.

5. Provider and Patient Features

Rohy AI may allow users to connect with providers or other recipients. Those features do not create a physician-patient, therapist-patient, or other professional relationship with Rohy AI.

• Users control whether to connect and what to share.
• Providers only access information intentionally shared by the user through the platform.
• Providers remain solely responsible for their own professional duties, judgments, and compliance obligations.
• Users remain responsible for deciding whether a provider or recipient is appropriate and authorized.

6. User Responsibilities

You are responsible for your account, your credentials, your use of AI-generated content, and your decision to rely on any summaries or outputs. You must not use Rohy AI for unlawful conduct, harmful activity, impersonation, abuse, or rights violations.

7. AI Output Disclaimer

AI outputs may be incomplete, inaccurate, biased, or unsuitable for your situation. You are solely responsible for evaluating whether any output is appropriate before acting on it.

8. Advanced Features, Clinical Models, and Beta Functionality

Some features may be experimental, advanced, configurable, or available only to certain plans or account states. Advanced Mode, clinical model pages, cognitive distortion tools, thought records, achievements, onboarding flows, provider workflows, and referral features may change, be limited, or be discontinued. Feature availability does not create an entitlement to a particular model, methodology, score, label, reward, badge, or clinical interpretation.

You are responsible for deciding whether advanced or clinical-style features are appropriate for you. If any output feels distressing, inaccurate, unsafe, or unsuitable, stop using that feature and seek support from a qualified professional where appropriate.

9. Referrals, Rewards, and Promotions

Rohy AI may offer referral links, badges, milestones, plan credits, trial extensions, premium days, share cards, or other promotional benefits. Rewards are promotional, non-transferable, have no cash value, may be subject to eligibility checks, and may be delayed, adjusted, denied, reversed, or terminated if we believe an account, referral, click, signup, payment, or conversion is fraudulent, abusive, duplicative, self-referential, misleading, unlawful, or inconsistent with the spirit of the program.

We may modify referral thresholds, badges, reward durations, plan names, estimated values, and eligibility criteria at any time. Referral dashboards and admin analytics are operational tools and may contain approximations, pending events, delayed conversions, or fraud-prevention flags.

10. Subscriptions, Usage, and Word Counts

Plan limits, word counts, token budgets, daily entry limits, upload rights, voice features, provider features, custom themes, and advanced-mode access are governed by the plan configuration in effect for your account. Usage counters are calculated server-side and may use interaction logs, monthly usage tables, account metadata, or other operational records. Counters may be corrected when stale, duplicated, missing, or inconsistent data is detected.

11. Suspension and Termination

We may suspend or terminate access if we reasonably believe your use violates these Terms, creates risk to others, or threatens the security or viability of the service.

12. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, ROHY AI IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, INCLUDING WARRANTIES OF ACCURACY, AVAILABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR SECURITY.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ROHY AI AND EVERBRIGHT VENTURES LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS INTERRUPTION ARISING OUT OF OR RELATED TO THE SERVICE.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR USD $100.

14. Indemnification

You agree to defend, indemnify, and hold harmless Rohy AI and Everbright Ventures LLC from claims arising out of your content, your misuse of the service, or your violation of these Terms or applicable law.

15. Governing Terms, Changes, and Contact

We may update these Terms from time to time. Continued use after an update means you accept the revised Terms to the extent permitted by law. If any provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver.
